Off-payroll reform was introduced in April 2021 in the private sector, shifting the responsibility of determining IR35 status from limited company contractors to medium and large size end clients. The fee-payer (in most cases the recruitment agency) is responsible for deducting and paying the relevant tax, Employer’s NI and Apprenticeship Levy to HMRC. The liability for incorrect status determinations sits with the fee-payer should HMRC successfully challenge status.

This means that a recruitment business (as the fee-payer) generally carries the most risk despite the end client being responsible for the status determination made.
